Livewill terms
Please read these Terms carefully before using Livewill. By using the platform, you agree to them.

1) Agreement & Acceptance
These Terms of Use ("Terms") are a legal agreement between you and Livewill. By accessing or using our website, apps, or services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use Livewill.
2) Description of Services
Livewill provides online tools to help users prepare estate-planning and related documents, store information, and manage account features. We may add, modify, or remove features at any time.
3) Not a Law Firm / Not Legal Advice
Livewill is not a law firm, does not provide legal representation, and does not give legal advice. Any content, prompts, templates, or generated documents are for general information and self-help drafting only. Documents are generated based on your own inputs and choices. You are solely responsible for reviewing the final documents and for deciding whether they meet your needs and applicable legal requirements. Where needed, you should seek independent legal advice from a qualified lawyer licensed in your jurisdiction.
4) Your Documents & Ownership
You retain ownership of the personal information and document content you submit to Livewill ("Your Content"). Subject to these Terms, Livewill grants you a limited, non-exclusive right to access and use documents generated for your personal, lawful purposes. You are responsible for confirming accuracy, legality, and proper execution (including witnessing, signing, and storage requirements under applicable law).
5) Account Responsibilities
- You must provide accurate and current information.
- You must maintain the confidentiality of your login credentials.
- You are responsible for all activity under your account.
- You must promptly notify us of suspected unauthorized access.
- You represent that you have legal capacity and authority to use the service.
6) Acceptable Use
You agree not to misuse Livewill. This includes, without limitation:
- Using the service for unlawful, fraudulent, or deceptive purposes.
- Uploading malicious code, interfering with security, or disrupting operations.
- Attempting unauthorized access to accounts, systems, or data.
- Using automated tools to scrape, reverse engineer, or copy protected platform features.
- Using Livewill on behalf of another person without lawful authority.
7) Limitation of Liability
To the maximum extent permitted by law, Livewill and its affiliates, officers, employees, contractors, and service providers are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, or opportunities arising from or related to your use of the service. To the extent liability cannot be excluded, Livewill's total aggregate liability for all claims arising from or relating to the service will not exceed the amount you paid to Livewill in the 12 months before the claim (or CAD $100 if you paid nothing), whichever is greater.
8) Intellectual Property
Livewill and its licensors own the platform, including software, designs, text, graphics, workflows, trademarks, and branding, except for Your Content. No rights are granted to you other than the limited rights expressly set out in these Terms.
9) Third-Party Services (Clerk, Convex, Stripe)
Livewill uses third-party providers to operate core functions, including authentication (Clerk), data and application infrastructure (Convex), and payments (Stripe). Your use of those integrated services may also be subject to their own terms and privacy practices. Livewill is not responsible for third-party systems beyond our reasonable control.
10) Termination or Suspension
We may suspend or terminate access to Livewill at any time, with or without notice, if we reasonably believe you violated these Terms, created security or legal risk, or used the service in a harmful way. You may stop using the service at any time. Sections that by nature should survive termination (including liability limits, ownership, dispute terms, and disclaimers) will continue to apply.
11) Governing Law (Ontario, Canada)
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules. You agree that courts located in Ontario, Canada will have exclusive jurisdiction over disputes arising from or relating to these Terms or your use of Livewill, subject to applicable consumer-protection laws.
12) Privacy
Your use of Livewill is also governed by our Privacy Policy, which explains how we collect, use, and protect personal information. Please review it at livewill.ca/privacy.
13) Changes to These Terms
We may update these Terms from time to time. When we do, we will post the revised version and update the "Last updated" date above. Your continued use of Livewill after changes take effect means you accept the updated Terms.
